We are not responsible for system downtime, lost data, etc. This disclaimer by Microland in no way affects the terms of a manufacturer's warranty, if any. Customer will assume the entire cost of all necessary servicing, repair or correction. In no event shall Microland's total liability to customer for any and all damages, losses and causes of action (whether in contract, tort (including, but not limited to, negligence) or otherwise) exceed the amount paid by customer, if any, to Microland for the specific merchandise at issue.

Governing Law:

Transactions between customer and Microland shall be governed by and construed in accordance with the laws of the State of California, without regard to the laws regarding conflicts of law.

If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Jurisdiction:

Unless otherwise specified, this website is presented solely for the purpose of promoting products available in the United States. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with laws governing export of software and other applicable laws, including local laws.

Any litigation regarding this agreement or any transaction between customer and Microland shall be brought in the state or federal courts located in Santa Clara County, California and customer hereby agrees and submits to such jurisdiction and venue as proper.

Errors and Omissions:

We strive to provide customer with the most accurate and up-to-date product information available. However, Microland is not responsible for typographical errors or technical inaccuracies on website. Microland may revise these terms and conditions at any time by updating this site. Customer agrees that if any part of these terms and conditions are found to be unenforceable, the remainder of these terms and conditions will remain in full force and effect.
